さて今回は、繰越欠損金を利用した節税についてのお話です。

繰越欠損金を利用した節税はレベルで表すと超初級編といっても良い方法で、税理士・会計士・弁護士等であれば例外なく誰でも知っています。上場企業の経理・財務はもちろん、中小企業の経理の方も知っているでしょう。それくらい基本のキの方法です。

ただ専門職以外はご存じない可能性もなきにしもあらずだと思うので、簡単に説明します。

既にご存じの方は、以降の文章は読まなくて構いません。

※ 資本金1億円以下の会社を前提にします。

繰越欠損金とは？

ざっくり繰越欠損金の節税について説明します。

例えば2014年に1,000万円の損失が生じたとします。これを翌期以降に繰り越します。

そして2015年に1,000万円の利益が生じました。

この2015年の利益1,000万円と2014年から繰越された損失1,000万円を合算とすると通算利益は０になります。

利益が０なので、税金は発生しません。

これが繰越欠損金による節税です。簡単ですね！

繰越欠損金は何年繰越しできるか？

この繰越欠損金ですが、永久に繰越せるわけではありません。

次のような制限があります。

・平成13年4月1日以後に開始した事業年度から平成20年4月1日前に終了した事業年度において生じた欠損金額については7年

・平成20年4月1日以後に終了した事業年度から平成29年4月1日前に開始する事業年度において生じた欠損金額については9年

・平成29年4月1日以後に開始する各事業年度において生じた欠損金額については10年

ざっくり言うと、最近発生した繰越欠損金は9年間繰越すことができます。

繰越欠損金の利用に制限があることを考えると、費用・損金の計上時期を遅くすればするほど将来、有効活用できる可能性が高くなります。

このことが焦点になるのは、既に損失の状態が出ている状況で、更に費用等を積み増すかという場面でしょう。

例えば、減価償却費計上前に既に最終損益が赤字であるときに、減価償却費を計上して更に損失を膨らませるかどうかという場面で判断がわかれると思います。

実際に、このケースでは会計事務所または担当者によって判断がわかれる可能性があります。

※ 上場企業の場合は、減価償却費を規則的に計上しないと監査法人からイエローカードを出されます。

中小企業の場合は、減価償却費を弾力的に処理している会社が多いです。

話を元に戻しますが、いずれにしても繰越欠損金は節税に役立ちます。
